Suit against voters' register in SC withdrawn

A former Youth Organiser for the People’s National Convention (PNC), Abu Ramadan, has had his lawyers withdraw a suit he filed at the Supreme Court seeking the highest court of the land to declare the 2012 register of voters null and void and a new one compiled in its place.

Mr Ramadan filed the case in December last year in which he argued that the register is not credible to be used for the November polls.

Chief Justice Georgina Wood, who presided over a panel to review the case granted Mr Ramadan’s lawyers’ request and cancelled the suit with an opportunity for the plaintiff to re-file.

Mr Ramadan took to the law courts after the Electoral Commission dismissed a petition by the opposition New Patriotic Party (NPP) demanding a fresh register of voters be compiled, with reason that there were over 76,000 names of Togolese on it.

The initial suit by Mr Ramadan sought the following:

1. A declaration that upon a true and proper interpretation of Article 45 (a) of the Constitution of the Republic of Ghana, 1992 (hereinafter, the “Constitution”) the mandate of the Electoral Commission of Ghana to compile the register of voters implies a duty to compile, fair and transparent register.

2. A declaration that the 2012 Voters Register which contains the names of persons who have not established qualification to be registered is inconsistent with Article 42 and 45 (a) and therefore unconstitutional, null, void and of no effect.

3. An order setting aside the 2012 Voters Register and compelling the Electoral Commission to compile fresh Voters Register before any new public election or referendum is conducted in this country.
